Please read these Terms of Service carefully before using Quizcade. By accessing or using the service, you agree to be bound by these terms. If you do not agree, do not use the service.

1. Acceptance of Terms

By creating an account, purchasing a subscription, event pass, or credit pack, or by simply using Quizcade (available at quizcade.com), you agree to these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Tsuf Barkai, the sole operator of Quizcade. If you are using Quizcade on behalf of an organization, you represent that you have authority to bind that organization to these terms.

You must be at least 13 years old to use Quizcade. If you are between 13 and 18 years of age, you may only use the service with the consent and supervision of a parent or legal guardian who agrees to be bound by these terms on your behalf.

2. Description of Service

Quizcade is a multiplayer quiz and drawing game platform. It allows hosts to create and run game sessions — including Jeopardy-style trivia and Drawing Duel — for groups of players joining via a shared PIN. Additional features include AI-powered question generation (via the Anthropic Claude API), a public question-set library, knowledge-base-grounded generation, custom branding, and game analytics. The service is provided over the internet and requires a stable connection to function correctly.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify users of significant changes in advance.

3. Account Registration

Quizcade uses Google OAuth as the sole authentication method. By signing in, you grant us access to your Google account's name, email address, and profile avatar. We do not store passwords. You are responsible for maintaining the security of your Google account and for all activity that occurs under your Quizcade account. You must notify us immediately at tsuf.barkai@gmail.com if you believe your account has been compromised. You may not create accounts for others without their consent, and you may not share your account credentials.

4. Subscriptions & Payments

Quizcade offers paid subscription tiers (Pro at $15/month or $150/year; Business at $39/month or $390/year) in addition to a free tier. All billing is handled by Paddle, which acts as the Merchant of Record for all transactions. By purchasing a subscription, you authorize Paddle to charge your payment method on a recurring basis (monthly or annually, depending on your plan).

  • You may cancel your subscription at any time through the billing portal. Your access will continue until the end of the current billing period; no partial-period refunds are issued.
  • Prices may change with at least 30 days' advance notice sent to your registered email address. Continued use after the notice period constitutes acceptance of the new price.
  • Failed payments may result in immediate downgrade to the Free tier. It is your responsibility to keep your payment method current.

5. Event Passes

Event passes (Game Night at $9; Corporate at $49) are one-time purchases that grant enhanced platform access for 48 hours from the moment of activation. Passes are non-refundable once activated. If you purchased a pass but have not yet activated it, you may contact us at tsuf.barkai@gmail.com within 24 hours of purchase to request a refund. Event passes are tied to a single access code and may not be transferred or resold.

6. AI Credits

AI credits are used for question generation powered by the Anthropic Claude API. 1 credit equals 1 standard AI generation; knowledge-base-grounded generation costs 3 credits. Credits are also granted as part of subscription plans and event passes. Credit packs (10 credits for $5; 25 credits for $10) may be purchased separately.

Purchased credits are non-refundable once acquired and persist in your account balance indefinitely — they do not expire. Credits granted as part of a subscription or event pass do not carry over beyond the subscription period or pass window.

7. User Content

You retain ownership of all question sets, knowledge-base content, and drawings you create on Quizcade. By uploading or publishing content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content solely for the purpose of operating and improving the service. This license ends when you delete the content or close your account.

You must not upload content that is illegal, defamatory, harassing, obscene, infringing of third-party intellectual property rights, or otherwise harmful. We reserve the right to remove content and suspend accounts that violate these standards without prior notice.

8. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of applicable laws.
  • Attempt to circumvent subscription limits, game player caps, or credit balances.
  • Reverse-engineer, scrape, or attempt unauthorized access to our systems or databases.
  • Use automated scripts to create accounts, join games, or generate content in bulk.
  • Distribute spam, malware, or phishing content through any feature of the platform.
  • Impersonate any person, organization, or Quizcade itself.

Violation of acceptable use policies may result in immediate account termination without refund.

9. Intellectual Property

The Quizcade name, logo, brand identity, source code, game mechanics, and all platform content created by us are the exclusive intellectual property of Tsuf Barkai. Nothing in these terms transfers any ownership rights to you. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the platform without express written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the service is at your sole risk.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TSUF BARKAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE QUIZCADE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Account Termination

By you: You may close your account at any time by emailing tsuf.barkai@gmail.com. Upon request, we will delete your account and personal data within 30 days in accordance with our Privacy Policy. Active subscriptions should be cancelled through the billing portal before requesting deletion; otherwise, any remaining subscription period will be forfeited without refund.

By us: We reserve the right to suspend or terminate your account at any time if you violate these terms, including the Acceptable Use policy. In cases of serious or repeated violations, termination may be immediate and without prior notice. If we terminate your account for reasons other than a terms violation, we will issue a prorated refund of any prepaid subscription fees.

13. Changes to Terms

We may update these Terms of Service from time to time. For material changes, we will provide at least 30 days' notice via email to your registered address or via a prominent notice on the platform. Continued use of the service after the effective date of any change constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.

14. Governing Law

These Terms of Service and any disputes arising out of or relating to them or the service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to the jurisdiction of such courts.
